You hit the nail on the head again Stu

Adam,
Speak to your attorney before you do anything-If they signed your contract and gave you a deposit they are obligated to pay you if the job was signed off in good order.
If they wanted a warranty it should have been noted in the contract prior to signing off on it. Contracts can be changed by either party and then signed to be formal.
You cant buy a car and stop making payments because you want an additional warranty.
Legal advice should come from your lawyer who is familiar with the laws in your state.
I think we should all speak to our lawyers to make sure we have a clause or exclusion protecting us against these type of tactics from individuals or companies.
Your lawyer may tell you to just write it out because john is right they could hang this up in court for a long time..

i just had to write a warranty letter as well...its either write out a letter or fight it out in court for a couple years...so i wrote it. Basically i wrote that the floor would still shiny unless abuse, scratched, blah blah blah...just a bunch of dribble and got my check. i spent more time writing what it did not cover , like etching, scratches, settling cracks, etc. normally these warranty letters are for a very limited time too, like one year..oh they also wanted it on the company letterhead...last 2 0r 3 jobs i have had to do this.

You're welcome Adam.  Another question for you...prior to completing the work...did your agreement include that payment would be based on receive such a document?  Commercial locations come up with the dumbest excuses not pay.  But if you didn't have this in your original agreement that you would be providing it...you are not obligated to provide it and they could be in breach of contract.

Partners,
I was asked to provide a warranty letter with the closing documents for the project we have completed in February. I explained to them that I can guarantee the workmanship only but they are looking for written letter. There is no problem with the slate floor, that we stripped, cleaned and sealed never less they are holding the payment until they get their paperwork in place (BS!!!!!!).

Do you have any letters or written clauses that I can use? I am tired of this bureaucratic crap.
