Simply registering the business name will cover you as well.

We are in Pa. 10 miles from New Jersey and Delaware so we service all 3 states
I recently had a situation where a carpet cleaning company named Classic Services from New Jersey started doing stone care and opened a business in Pa. and N.J. named Classic Marble & Stone Restorations and built a website Classicmarblerestorations.com.
They just added a S to the end of our name started trading.
If it wasn't for us being incorporated in all 3 states and having our website Classicmarbleandstonerestoration.com they could have piggybacked off of our 27 year great reputation.
We could have spent a lot of money fighting them but because we were already incorporated all it took was a letter from my lawyer.
